Minnesota Bail Bonds Lawyers & Attorneys
When it comes to bail bonds, attorneys and bail bondsman work closely together in Minnesota.
When an individual is arrested for a crime, such as DWI, he or she may be subject to a bail hearing, but be held in jail until that bail hearing if the court believes that the individual may be a danger to the public or if that person is likely to not return to court.
Bail is usually set as a monetary figure that must be paid by the defendant in order to be released until the next court proceeding. If the defendant fails to appear before the court in the future, then the amount of the bail is forfeited to the court.
Bail Hearing
A bail hearing in Minnesota is a hearing that is used to determine the amount of bail. There are several factors that go into the court’s decision as to how much the bail needs to be. Those factors include:
Community ties of the defendant
Nature of their employment and how long they’ve been employed
Family members that are present at the hearing
Involvement in the community
History of court appearances and criminal record, if any
Minnesota Bail Bondsman
The bail bondsman has a very unique role in the bail process. The bondsman posts bail for the defendant in order to secure their release. In exchange for bail being posted, the defendant agrees to pay a fee that is a percentage of the bail that was posted. This could be in the form of a lien or some kind of security interest in another asset to make sure the bondsman is paid if the defendant “jumps” bail by not making future court appearances.
It is important to choose a good bail bondsman to take care of your bail for you. Rates are one thing you must look at. Most in Minneapolis and the entire state of Minnesota have competitive rates. This allows you to talk to different bondsmen and negotiate with them to get the best rates possible. However, make sure they have what you require, such as make sure they service the particular jail where bail must be posted. It is also important to note how fast bail can be posted, if collateral is required, and if there are payment plans that are offered.
Once the bail bondsman posts bail, the jail release process will begin. This process can take minutes or it can take hours depending on how busy the jail is and if the entire booking process had been completed by that point.
