In Minnesota, DWI is a severe criminal offense. If you find yourself pulled over by the police for suspected drunk driving, and they have probable cause to believe you have violated the law, you have more or less already given your consent to do testing when you got your driver’s license, or chose to drive in Minnesota even without a Minnesota license.. However, you do have rights. You do not have to admit guilt to any crime. Although you do have the ability to withdraw from participating in certain sobriety tests, you will likely be arrested for DWI and taken to the police station for booking. It is there that you will undergo official alcohol testing. If you then refuse to have your alcohol concentration tested via breath, urine, or blood, you are automatically subjecting yourself to a one year license revocation, and you have just committed a separate, gross misdemeanor crime of test refusal.
Blood, Breath, & Urine Testing
A breath, blood, or urine test is, historically, the best way to produce evidence of an individual being intoxicated while driving a motor vehicle. By refusing the tests, then the crime is elevated due to the test refusal. The prosecution for DWI can still move forward even without a test record and a conviction can result for both DWI and refusal. Other types of evidence are admissible such as the testimony of the police officer who pulled you over or any other officer involved in the pulling over of your vehicle.
Know that you are entitled to consult with a DWI lawyer before you ever consent to the test at the station, after being arrested. When suspected of DWI, you should be read the Implied Consent Advisory (ICA), which states that by obtaining a driver’s license you have given your consent to take a test, that test refusal is a crime, and that you do have the right to consult with an attorney within reasonable time before taking any tests. The first thing that you should do is tell the law enforcement officer that you want to consult with your attorney before you do or say anything.
