Minnesota Intoxilyzer Source Code Lawyers

When determining that an individual is intoxicated at the time of their DWI arrest, a machine called an Intoxilyzer is used. This machine is a very important part of Minnesota DWI convictions and DWI convictions all around the country.

In May, the Minnesota Supreme Court in the case the State v. Underdahl and Brunner, it was stated that the state of Minnesota must produce the source code to the Intoxilyzer 5000 EN if a charged individual can show that the code relates to their innocence or guilt in a DWI case. The defendants, Underdahl and Brunner sought out discovery of the source code after being charged with DWI.

In both of these cases, the state of Minnesota was ordered to produce the source code within one month or the breath tests that were conducted at the time of the DWI arrests would not be admissible into the court and the charges would be dismissed. This benefitted the Brunner case in that it was argued that it is important that source codes are revealed in order to show any defects in the machine.

Intoxilyzer Source Code Defense

In the case of Brunner, source code definitions were submitted and it was through the written testimony by a computer science professor that stated issues surrounding those source codes. It is very possible for the source code to reveal deficiencies that could cause individuals to heavily question the results of the Intoxilyzer. This enabled Brunner to use the defense that these possible deficiencies could relate to guilt or innocence. If the machine was wrong, then it is possible that Brunner’s blood alcohol content was over the legal limit further or actually under it. When a machine is defective, it is difficult to tell which would be accurate, making the evidence not strong enough for the charges to stand.

Being that the validity of the Intoxilyzer is being challenged all over the country, breath tests may be a thing of the past. With the source code being heavily questioned and the possibility that there may be defects, many individuals may be falsely charged.
