If you find yourself in the situation where you have failed a blood, breath, or urine test after being pulled over by law enforcement for suspected DWI, or you refused to take the field sobriety tests, your license may be revoked immediately. Typically, you are given a temporary license for 7 days before the revocation process is complete.

Here are some things that you need to understand about license revocation due to DWI charges or related charges:

  • You need to know that the license revocation process in Minnesota moves quite fast. This is why you need a Minnesota DWI lawyer as soon as possible. The state is not going to waste any time, so you shouldn’t either. Your license is important to you and it is crucial that you try to do what you can to keep it.

  • Minnesota law states that there are different periods of time in which a license can be revoked for. A license can also be cancelled depending on the circumstances in the case.

  • You may have a 90 day revocation if you have not had any prior impaired driving incidents in the previous ten years and no aggravating factors were present at the time.

  • If you are under the age of 21, your license may be revoked for up to 6 months.

  • If you have an impaired driving incident within the previous ten years, then you could have your license revoked for 6 months, or a year if the test is .20 or greater.

  • If you refused to take a urine, blood, or breath test, then your license can be revoked for up to a year.

  • Pending rehabilitation and treatment, your license may be canceled indefinitely if you have had 3 or more impaired driving incidents within the past 10 years, or 4 in a lifetime.

Remember that you do have rights in the revocation or cancellation of your license. Know that you may qualify for a limited driver’s license if you need to seek employment, drive to and from your job, need to attend chemical dependency treatment, to provide for the needs of your family, or to further your education.
