Once you have been convicted of a crime or DWI in Minnesota, you will still have some involvement in the court system. Your case is far from over once you leave the court room with a conviction under your belt. You then have to face probation and violation of that probation can land you in jail or prison. Some of the common conditions of probation include:

  • Having no similar offenses

  • Continuing to abide by the law

  • A certain amount of jail time may be served

If any of these conditions are not adhered to during the probationary period, then penalties will be imposed, making the journey through the legal system an even longer one. Admit-Deny Hearing and Evidentiary Hearing

If you have been accused of violating the terms of your probation, you will be asked by the court if you want to admit to or deny that a violation of your probation did occur. If you go ahead and admit that you violated your probation, the court will then move forward with the consequences. These consequences could be jail time, community service, fines, and any other penalty that a judge sees fit.

If you deny that you violated your probation, then an evidentiary hearing will be held. This is a hearing in which any evidence that you did or didn’t violate your probation is presented. If it is found that you have violated your probation, a penalty will be imposed. If it is found that you have not violated your probation, then you will go on as you have during your probation.
