Minnesota Vehicle Forfeitures Attorney & Lawyer

The state of Minnesota has taken a zero tolerance stance against individuals driving while under the influence of alcohol or any other controlled substance. If you have been charged with a DWI, then you are likely to face a variety of very serious penalties and sanctions.

These penalties and sanctions can include:

  • Large fines

  • Significant jail time

  • License plate impoundment

  • License revocation

  • Motor vehicle forfeiture

If motor vehicle forfeiture is one of the penalties that you are facing due to being charged with a DWI, you need a DWI lawyer to help you in your case. You need an attorney with a proven track record for providing people with effective representation in cases just like yours.

While most individuals are familiar with the basics of DWI laws, they are not usually familiar with the administrative penalties that can be imposed by the court. These are also considered civil penalties and vehicle forfeitures are a part of these penalties.

Vehicle forfeiture or the forfeiture of property is nothing new. Different types of forfeiture laws have been enacted all over the United States in the past two decades. These forfeiture laws involve everything form vehicles to real estate. When individuals have been charged with alcohol-related crimes or drug crimes, the forfeiture of property is a potential penalty. In Minnesota, the vehicle forfeiture law is considered to be one that is often harsher than the forfeiture laws that exist in other states.

Minnesota law says that a law enforcement officer has the legal authority to take your vehicle if you are suspected of drunk driving at the time you are arrested, if certain prior offenses exist, or the test I .20 or greater, or a child is in the vehicle, or you have a “no-use” restriction on your license already, or you are driving while your license is canceled for prior DWIs, or prior revocations. After the vehicle has been seized, the officer then serves a notice that states that they intend to seek a forfeiture of the vehicle.

If you have been served with an intent to forfeit your vehicle, you do need to speak to a DWI lawyer to find out what your rights are and how you can prevent your vehicle from being taken from you. You have the right to have what is called judicial determination, which means you have to file a challenge to the forfeiture within a certain period of time from the date in which the intent to forfeit was served. It is only 30 days! If you do not present your challenge, then in the eyes of the court you have waived your right to judicial determination. That is why you must speak to a Minneapolis DWI attorney as soon as you are arrested because your attorney will stay by your side throughout all aspects of your case.
